The 28 years old Police Corporal, Aremu Musefiu who allegedly killed a mother of four, Late Comfort Sunday Godwin, at Isheri-Oshun Lagos on September 16, 2015, is to face a two count-charge of attempted murder and murder before a Lagos High Court.
His prosecution before the High Court on the two count charges, was based on the recommendations of a legal advice from the office of the Directorate of Public Prosecution (DPP) Lagos.
Parts of the DPP’s advice marked LJP/HOM/2015/131/10, and signed By Mrs. Taiwo Lambo, an Assistant Chief State Counsel reads: “this office has carefully studied the facts available in the duplicate case file and it is of the the opinion that a prima facia case of the the offence of attempted murder and murder contrary to sections 228 and 221 of the criminal laws of Lagos state are revealed against the Page B1-‘Aremu Musefiu’.
“In the instant case, it is evidence that B1 ‘Aremu Musefiu’, intentionally killed and caused grievous harm on the occupants of the tricycle. Aremu Musefiu confessed that he fired his rifle on the tricycle which injured Page A4 on the jaw and killed Comfort Sunday Godwin.
“In view of the foregoing, this office advises prosecution of Aremu Musefiu for the offences of attempted murder and murder contrary to sections 228 and 221of the criminal Laws of Lagos state, 2011.”
After reading the DPP’s, by Chief Magistrate Afolashade Botoku, she ordered that the matter be transfer the state Johnson Court for the accused person’s prosecution.
The 28 year old Corporal, attached to Isheri-Oshun Police Division, was alleged to have killed late Comfort Godwin Sunday, and also wounding her husband, Godwin Sunday, with his official rifle, AK 47, at Ijegun area of the state, on September 16, 2015, at about 8 p.m.
He was charged before Chief Magistrate Afolashade Botoko, who ordered his remand in prisons custody pending an advice from the Office of the Director Public Prosecution, DPP, on September 18, 2015.
