A Federal High Court sitting in Abuja has struck out a suit filed by the governor of the Central Bank of Nigeria, Godwin Emefiele, in which wanted the Independent National Electoral Commission (INEC) and the Attorney-General of the Federation (AGF) to be restrained from stopping his presidential bid.

He had asked the court to restrain the INEC and the AGF from stopping or precluding him from participating, voting or being voted for at the congress or convention of any political party based on the provision of Section 84(12) of the Electoral Act 2022.

This followed an application by Emefiele to withdraw the suit.

Counsel to Emefiele, S.T. Maliki, announced the withdrawal after the matter was called on Monday, adding that a notice of discontinuance had been filed before the court.

Maliki, who stood in for lead counsel, Mike Ozekhome (SAN), said the notice of discontinuance dated May 16, 2022, had been served on all the defendants in the matter.

Counsel to the Save Nigeria Our Fatherland, John Aikpokpo-Martins, opposed the withdrawal, asking the court to award the sum of N1.5m cost against the applicant.

But counsel to the AGF and that of the INEC did not oppose the withdrawal.

However, in his ruling, Justice Ahmed Mohammed of the Federal High Court struck out the suit, saying Emefiele had the right to withdraw same.
